What is the collaborative approach?

The Collaborative Approach is a way of dealing with family disputes in which each person appoints their own lawyer and you all meet together to work things out face to face in a series of meetings.

Each of you will have your lawyer with you throughout the entire process and therefore you will benefit from legal advice as you go. The aim of the collaborative approach is to resolve family disputes without going to court and the process involves you and your partner signing an agreement in which you clearly state your intention to deal with matters without involving the Court. This is because it is important to establish a positive intention by everyone involved to deal with matters constructively and openly.

What are the benefits of the collaborative approach?

One of the benefits of the collaborative approach is that it’s not driven by a timetable imposed by the court. So to a large extent, the process can be built around your family’s individual timetable and priorities.
